{"id":56108,"date":"2023-06-22T14:02:20","date_gmt":"2023-06-22T14:02:20","guid":{"rendered":"https:\/\/www.climatepolicyinitiative.org\/?post_type=cpi_publications&#038;p=56108"},"modified":"2026-05-18T19:10:30","modified_gmt":"2026-05-18T19:10:30","slug":"implementacao-do-codigo-florestal-em-roraima-reducao-de-reserva-legal-de-80-para-50-pode-acelerar-o-desmatamento-no-estado","status":"publish","type":"cpi_publications","link":"https:\/\/www.climatepolicyinitiative.org\/pt-br\/publication\/implementacao-do-codigo-florestal-em-roraima-reducao-de-reserva-legal-de-80-para-50-pode-acelerar-o-desmatamento-no-estado\/","title":{"rendered":"Implementa\u00e7\u00e3o do C\u00f3digo Florestal em Roraima: Redu\u00e7\u00e3o de Reserva Legal de 80% para 50% Pode Acelerar o Desmatamento no Estado"},"content":{"rendered":"\n<p>O C\u00f3digo Florestal (Lei n\u00ba 12.651\/2012) \u00e9 a principal pol\u00edtica p\u00fablica nacional de conserva\u00e7\u00e3o da vegeta\u00e7\u00e3o nativa em \u00e1reas privadas por meio de dois instrumentos de conserva\u00e7\u00e3o: as \u00c1reas de Preserva\u00e7\u00e3o Permanente (APP) e a Reserva Legal.<\/p>\n\n\n\n<p>Em 2022, Roraima concluiu o Zoneamento Ecol\u00f3gico-Econ\u00f4mico do estado (ZEE-RR) e adotou legisla\u00e7\u00e3o reduzindo a prote\u00e7\u00e3o da Reserva Legal nas \u00e1reas destinadas ao uso produtivo. Pesquisadores do Climate Policy Initiative\/Pontif\u00edcia Universidade Cat\u00f3lica do Rio de Janeiro (CPI\/PUC-Rio) identificaram que <strong>a diminui\u00e7\u00e3o da prote\u00e7\u00e3o da vegeta\u00e7\u00e3o nativa, embora permitida por lei, pode se tornar um \u201cconvite ao desmatamento\u201d. Esta mudan\u00e7a na pol\u00edtica florestal coloca o estado na contram\u00e3o das metas clim\u00e1ticas nacionais de redu\u00e7\u00e3o do desmatamento e de promo\u00e7\u00e3o de incentivos para a conserva\u00e7\u00e3o da floresta. Al\u00e9m disso, outros estados da Amaz\u00f4nia, como Amap\u00e1 e Amazonas podem seguir o exemplo de Roraima, colocando em risco a prote\u00e7\u00e3o legal de milh\u00f5es de hectares de florestas em \u00e1reas priorit\u00e1rias para a conserva\u00e7\u00e3o<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Previs\u00e3o legal de redu\u00e7\u00e3o do percentual de Reserva Legal nos estados da Amaz\u00f4nia<\/h2>\n\n\n\n<p>O C\u00f3digo Florestal estabelece que todo im\u00f3vel rural deve manter um percentual da \u00e1rea com vegeta\u00e7\u00e3o nativa conservada a t\u00edtulo de Reserva Legal. A lei florestal, entretanto, estabelece regras diferenciadas para im\u00f3veis localizados na Amaz\u00f4nia Legal.<\/p>\n\n\n\n<p>Os percentuais de Reserva Legal na Amaz\u00f4nia Legal variam em fun\u00e7\u00e3o do tipo de vegeta\u00e7\u00e3o: em \u00e1reas de floresta, a Reserva Legal deve ser de 80%; em \u00e1reas de cerrado, de 35%; e em campos gerais, de 20% (Figura 1).&nbsp;Dado que a maior parte da Amaz\u00f4nia Legal \u00e9 constitu\u00edda por \u00e1reas de floresta, evidencia-se que quase toda a regi\u00e3o est\u00e1 sujeita a regras mais r\u00edgidas de conserva\u00e7\u00e3o.<\/p>\n\n\n\n<p><strong>Figura 1.<\/strong> Percentual de Reserva Legal na Amaz\u00f4nia Legal por Tipo de Vegeta\u00e7\u00e3o<\/p>\n\n\n\n<p><img loading=\"lazy\" decoding=\"async\" width=\"900\" height=\"254\" class=\"wp-image-56118\" style=\"width: 900px;\" src=\"https:\/\/www.climatepolicyinitiative.org\/wp-content\/uploads\/2023\/06\/FIG-UM-1.png\" alt=\"\" srcset=\"https:\/\/www.climatepolicyinitiative.org\/wp-content\/uploads\/2023\/06\/FIG-UM-1.png 2006w, https:\/\/www.climatepolicyinitiative.org\/wp-content\/uploads\/2023\/06\/FIG-UM-1-300x85.png 300w, https:\/\/www.climatepolicyinitiative.org\/wp-content\/uploads\/2023\/06\/FIG-UM-1-1024x289.png 1024w, https:\/\/www.climatepolicyinitiative.org\/wp-content\/uploads\/2023\/06\/FIG-UM-1-1536x434.png 1536w\" sizes=\"auto, (max-width: 900px) 100vw, 900px\" \/><\/p>\n\n\n\n<p><em><strong>Fonte:<\/strong> CPI\/PUC-Rio, 2023<\/em><\/p>\n\n\n\n<p>A regi\u00e3o da Amaz\u00f4nia Legal tamb\u00e9m concentra a maior extens\u00e3o de \u00e1reas protegidas do pa\u00eds \u2014 Terras Ind\u00edgenas (TIs) e Unidades de Conserva\u00e7\u00e3o (UCs). Na revis\u00e3o da lei florestal, que culminou com a aprova\u00e7\u00e3o do novo C\u00f3digo Florestal de 2012, incluiu-se a previs\u00e3o de redu\u00e7\u00e3o do percentual de Reserva Legal para im\u00f3veis no bioma Amaz\u00f4nia, levando em considera\u00e7\u00e3o a extens\u00e3o das \u00e1reas protegidas.<\/p>\n\n\n\n<p>De acordo com a atual reda\u00e7\u00e3o do C\u00f3digo Florestal, o poder p\u00fablico estadual pode, com a participa\u00e7\u00e3o do Conselho Estadual de Meio Ambiente, reduzir o percentual da Reserva Legal das \u00e1reas cobertas por floresta na Amaz\u00f4nia Legal de 80% para 50%, quando o estado tiver ZEE aprovado e quando mais de 65% do seu territ\u00f3rio for ocupado por UCs de dom\u00ednio p\u00fablico, devidamente regularizadas, e por TIs homologadas.<a id=\"_ftnref1\" href=\"#_ftn1\"><sup>[1]<\/sup><\/a><\/p>\n\n\n\n<p>Roraima e Amap\u00e1 s\u00e3o os \u00fanicos estados do bioma Amaz\u00f4nia que atingem, atualmente, o percentual de, no m\u00ednimo, 65% do territ\u00f3rio ocupado por UCs de dom\u00ednio p\u00fablico e por TIs homologadas.<a id=\"_ftnref2\" href=\"#_ftn2\"><sup>[2]<\/sup><\/a> O Amazonas possui extensas \u00e1reas p\u00fablicas n\u00e3o designadas e, caso essas \u00e1reas sejam destinadas para a cria\u00e7\u00e3o de UC de dom\u00ednio p\u00fablico e\/ou demarca\u00e7\u00e3o de TIs, o Amazonas tamb\u00e9m poder\u00e1 se qualificar nessa hip\u00f3tese legal de redu\u00e7\u00e3o do percentual de Reserva Legal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cria\u00e7\u00e3o do Zoneamento Ecol\u00f3gico-Econ\u00f4mico do Estado de Roraima e a Redu\u00e7\u00e3o do Percentual de Reserva Legal<\/h2>\n\n\n\n<p><strong>Com o objetivo de diminuir a prote\u00e7\u00e3o em im\u00f3veis rurais privados, assentamentos da reforma agr\u00e1ria e \u00e1reas p\u00fablicas pass\u00edveis de regulariza\u00e7\u00e3o fundi\u00e1ria, liberando \u00e1reas para a produ\u00e7\u00e3o agropecu\u00e1ria no estado, o governo de Roraima aprovou, em 2022, o ZEE do estado e, ao mesmo tempo, criou quatro novas UCs de dom\u00ednio p\u00fablico, alcan\u00e7ando mais de 65% de \u00e1reas protegidas de dom\u00ednio p\u00fablico no estado<\/strong> (Figura 2). Essas UCs foram criadas a partir da recategoriza\u00e7\u00e3o da \u00c1rea de Prote\u00e7\u00e3o Ambiental (APA) do Baixo Rio Branco, um tipo de UC que abrange terras p\u00fablicas e privadas, em Parque Estadual das Nascentes, Reserva de Desenvolvimento Sustent\u00e1vel (RDS) Itapar\u00e1-Boia\u00e7u e RDS Campina, al\u00e9m da cria\u00e7\u00e3o da RDS Xeriuini, em sobreposi\u00e7\u00e3o a uma APA municipal existente com o mesmo nome.<\/p>\n\n\n\n<p>Ainda que as APAs do Baixo Rio Branco e Xeriuini fossem constitu\u00eddas por terras p\u00fablicas, esse tipo de UC n\u00e3o exclui a possibilidade de regulariza\u00e7\u00e3o fundi\u00e1ria para ocupa\u00e7\u00f5es privadas. Posteriormente, o governo estadual editou o Decreto n\u00ba 33.467-E, de 31 de outubro de 2022 estabelecendo a redu\u00e7\u00e3o do percentual de Reserva Legal de 80% para 50% nas \u00e1reas de floresta do estado. Esta mudan\u00e7a foi chancelada pelo Conselho Estadual de Meio Ambiente de Roraima por meio da Resolu\u00e7\u00e3o CEMA n\u00ba 3 de 25 de novembro de 2022.<\/p>\n\n\n\n<p>Ressalta-se que apesar das UCs de dom\u00ednio p\u00fablico de Roraima permitirem, em tese, o alcance do percentual de 65% de \u00e1reas protegidas para fins de redu\u00e7\u00e3o do percentual de Reserva Legal, nos termos do Art. 12, \u00a7 5\u00ba do C\u00f3digo Florestal, a lei federal deixa expresso que as UCs precisam estar devidamente regularizadas, ou seja, sem pend\u00eancias fundi\u00e1rias. O Cadastro Nacional de Unidades de Conserva\u00e7\u00e3o (CNUC) n\u00e3o traz informa\u00e7\u00f5es sobre a situa\u00e7\u00e3o fundi\u00e1ria das UCs de Roraima, mas publica\u00e7\u00f5es acad\u00eamicas sugerem haver problemas fundi\u00e1rios e de ocupa\u00e7\u00e3o irregular.<a id=\"_ftnref3\" href=\"#_ftn3\"><sup>[3]<\/sup><\/a> Essa perspectiva foi confirmada em auditoria do Tribunal de Contas da Uni\u00e3o (TCU) que constatou que grande parte da \u00e1rea das UCs federais de dom\u00ednio p\u00fablico est\u00e1 pendente de regulariza\u00e7\u00e3o fundi\u00e1ria.<a id=\"_ftnref4\" href=\"#_ftn4\"><sup>[4]<\/sup><\/a> Nesse caso, o estado precisa alcan\u00e7ar materialmente o percentual de 65% de \u00e1reas protegidas sob o dom\u00ednio p\u00fablico, e n\u00e3o apenas \u201cno papel\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Redu\u00e7\u00e3o do percentual de Reserva Legal e impacto no desmatamento em Roraima<\/h2>\n\n\n\n<p><strong>A flexibiliza\u00e7\u00e3o da prote\u00e7\u00e3o nos im\u00f3veis rurais no estado de Roraima, por meio da redu\u00e7\u00e3o do percentual de Reserva Legal, pode ter consequ\u00eancias catastr\u00f3ficas para a floresta, o clima e a biodiversidade.<\/strong><\/p>\n\n\n\n<p>Freitas et al. levantaram o impacto potencial na redu\u00e7\u00e3o do percentual de Reserva Legal nos estados do Amazonas, Roraima e Amap\u00e1 e identificaram que, s\u00f3 em Roraima, aproximadamente dois milh\u00f5es de hectares, contendo aproximadamente 267 milh\u00f5es de toneladas de carbono, perderiam a prote\u00e7\u00e3o legal. Al\u00e9m disso, 70% da \u00e1rea eleg\u00edvel nos tr\u00eas estados para a redu\u00e7\u00e3o de Reserva Legal coincidem com \u00e1reas priorit\u00e1rias para a conserva\u00e7\u00e3o, sendo que metade delas de import\u00e2ncia extremamente alta para a conserva\u00e7\u00e3o da biodiversidade.<a id=\"_ftnref5\" href=\"#_ftn5\"><sup>[5]<\/sup><\/a><\/p>\n\n\n\n<p>Esses impactos negativos j\u00e1 est\u00e3o acontecendo em Roraima. De acordo com os dados do Relat\u00f3rio Anual de Desmatamento (RAD) no Brasil 2022,<a id=\"_ftnref6\" href=\"#_ftn6\"><sup>[6]<\/sup><\/a> do MapBiomas, os alertas de desmatamento coincidem com as \u00e1reas privadas ou \u00e1reas p\u00fablicas destinadas a assentamentos ou regulariza\u00e7\u00e3o fundi\u00e1ria (titula\u00e7\u00e3o), que est\u00e3o na zona destinada \u00e0 produ\u00e7\u00e3o agropecu\u00e1ria no estado. Os dados levantados pelo MapBiomas mostram que de 2019 a 2022 houve 8.121 alertas de desmatamento em Roraima, cobrindo uma \u00e1rea de 93.205 hectares. Ressalta-se que o desmatamento nessas \u00e1reas \u00e9, em sua maioria, ilegal, pois apenas 12,3% da \u00e1rea desmatada foi autorizada pela autoridade competente. Al\u00e9m disso, apenas 8% da \u00e1rea desmatada ilegalmente foi objeto de a\u00e7\u00f5es de repress\u00e3o pelos \u00f3rg\u00e3os federais (Ibama e Minist\u00e9rio P\u00fablico Federal), por meio de embargos, autos de infra\u00e7\u00e3o e a\u00e7\u00f5es civis p\u00fablicas. De acordo com o relat\u00f3rio do MapBiomas, n\u00e3o foi poss\u00edvel encontrar nenhuma informa\u00e7\u00e3o sobre a atua\u00e7\u00e3o dos \u00f3rg\u00e3os estaduais contra o desmatamento ilegal.<\/p>\n\n\n\n<p><strong>Antes da redu\u00e7\u00e3o dos percentuais de Reserva Legal em Roraima, j\u00e1 havia um cen\u00e1rio de aumento do desmatamento ilegal nas \u00e1reas com ocupa\u00e7\u00e3o privada (titulada ou n\u00e3o). Agora, essa flexibiliza\u00e7\u00e3o, embora permitida por lei, pode impulsionar o desmatamento no estado, contribuindo para emiss\u00f5es de gases de efeito estufa e perda de biodiversidade. Al\u00e9m disso, essa decis\u00e3o de Roraima pode incentivar outros estados da Amaz\u00f4nia a seguir o mesmo caminho, com impactos em maior escala.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><a id=\"_ftn1\" href=\"#_ftnref1\">[1]<\/a>&nbsp;Lei n\u00ba 12.651.
