Essa semana, no dia 5 de junho, comemora-se o dia Mundial do Meio Ambiente. Para festejar estas datas t\u00e3o importantes, o Congresso Nacional presenteia a sociedade brasileira com um pacote de projetos de lei que impactam fortemente a prote\u00e7\u00e3o ambiental, incluindo graves altera\u00e7\u00f5es ao C\u00f3digo Florestal.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.climatepolicyinitiative.org\/pt-br\/publication\/barometro-do-codigo-florestal-no-legislativo\/\" target=\"_blank\" rel=\"noreferrer noopener\"><u>O Bar\u00f4metro do C\u00f3digo Florestal no Legislativo<\/u><\/a>, uma iniciativa do Climate Policy Initiative\/Pontif\u00edcia Universidade Cat\u00f3lica do Rio de Janeiro (CPI\/PUC-Rio) que mede a press\u00e3o para altera\u00e7\u00e3o do C\u00f3digo Florestal no Congresso Nacional, <strong>indica que os PLs n\u00ba 2374\/2020 e 1282\/2019 est\u00e3o com press\u00e3o m\u00e1xima e podem ser aprovados, ainda esta semana, na Comiss\u00e3o de Agricultura e Reforma Agr\u00e1ria do Senado Federal (CRA)<\/strong>. Ambos os PLs tramitam em car\u00e1ter terminativo na CRA, ou seja, se aprovados seguem direto para a C\u00e2mara dos Deputados, sem passar pela Comiss\u00e3o de Meio Ambiente (CMA) ou mesmo pelo plen\u00e1rio do Senado.<\/p>\n\n\n\n<p>Esses dois projetos de lei impactam fortemente os dois institutos mais importantes para a prote\u00e7\u00e3o da vegeta\u00e7\u00e3o nativa em \u00e1reas privadas, as \u00c1reas de Preserva\u00e7\u00e3o Permanentes (APPs) e a Reserva Legal. Desta forma, suas eventuais aprova\u00e7\u00f5es merecem ser precedidas de um amplo debate em audi\u00eancias p\u00fablicas, com participa\u00e7\u00e3o ativa da CMA. A tramita\u00e7\u00e3o de ambos, em apenas uma comiss\u00e3o, indica uma forte articula\u00e7\u00e3o pol\u00edtica para a altera\u00e7\u00e3o do C\u00f3digo Florestal.<\/p>\n\n\n\n<p><strong><a href=\"https:\/\/www.climatepolicyinitiative.org\/pt-br\/publication\/senado-presenteia-os-10-anos-do-codigo-florestal-com-mais-anistia-aos-desmatadores\/\" target=\"_blank\" rel=\"noreferrer noopener\"><u>Pesquisadoras do CPI\/PUC-Rio analisaram o PL n\u00ba 2374\/2020<\/u><\/a> e identificaram que o projeto concede uma anistia, injustificada, \u00e0queles que promoveram o desmatamento ilegal de \u00e1reas de Reserva Legal<\/strong>. O PL n\u00ba 2374\/2020 amplia em quatro anos o marco legal da regulariza\u00e7\u00e3o de \u00e1reas consolidadas em Reserva Legal. A proposta permite que desmatamentos ocorridos at\u00e9 25 de maio de 2012 sejam regularizados, na modalidade de compensa\u00e7\u00e3o, desde que a \u00e1rea compensada seja o dobro da \u00e1rea de Reserva Legal consolidada. Hoje, apenas \u00e1reas desmatadas em Reserva Legal at\u00e9 22 de julho de 2008 s\u00e3o pass\u00edveis de compensa\u00e7\u00e3o, qualquer supress\u00e3o de vegeta\u00e7\u00e3o, posterior a esta data, precisa ser restaurada no pr\u00f3prio im\u00f3vel rural.<\/p>\n\n\n\n<p>Embora o PL proponha uma compensa\u00e7\u00e3o pelo dobro da \u00e1rea desmatada, acenando para a possibilidade de um ganho ambiental, em realidade, a pretendida altera\u00e7\u00e3o do marco temporal \u00e9 uma medida extremamente danosa para a implementa\u00e7\u00e3o do C\u00f3digo Florestal. Caso aprovado, o PL aumentar\u00e1 a \u00e1rea anistiada de Reserva Legal e impactar\u00e1 a etapa de an\u00e1lise e valida\u00e7\u00e3o do Cadastro Ambiental Rural (CAR), em andamento nos estados.<\/p>\n\n\n\n<p>Al\u00e9m disso, essa medida representa um grave precedente para que o marco temporal da regulariza\u00e7\u00e3o ambiental, pilar fundamental do C\u00f3digo Florestal e que norteou todas as negocia\u00e7\u00f5es para a sua aprova\u00e7\u00e3o em 2012, seja rediscutido para todas as \u00e1reas consolidadas, com implica\u00e7\u00f5es que podem ir bem al\u00e9m da prote\u00e7\u00e3o da vegeta\u00e7\u00e3o nativa. Por fim, a anistia prevista no PL n\u00ba 2374\/2020 parece capaz de beneficiar somente um seleto grupo de m\u00e9dios e grandes produtores rurais que se enquadrariam no novo marco temporal.<\/p>\n\n\n\n<p><strong>Por sua vez, o PL n\u00ba 1282\/2019 prop\u00f5e altera\u00e7\u00f5es no regime de prote\u00e7\u00e3o das \u00c1reas de Preserva\u00e7\u00e3o Permanente (APP) do C\u00f3digo Florestal que podem ter impactos bastante significativos.<\/strong> O projeto permite a interven\u00e7\u00e3o e a supress\u00e3o de vegeta\u00e7\u00e3o em APP de cursos d\u2019\u00e1gua, para a constru\u00e7\u00e3o de reservat\u00f3rios de \u00e1gua para irriga\u00e7\u00e3o, por meio de barramento de cursos d\u2019\u00e1gua e da infraestrutura a ele associada.<\/p>\n\n\n\n<p>As APPs s\u00e3o \u00e1reas sens\u00edveis e necess\u00e1rias para a preserva\u00e7\u00e3o de servi\u00e7os ambientais essenciais, tais como: fornecimento de \u00e1gua, regula\u00e7\u00e3o do ciclo hidrol\u00f3gico e clim\u00e1tico, manuten\u00e7\u00e3o da biodiversidade e estabilidade geol\u00f3gica e prote\u00e7\u00e3o do solo. A APP de curso d\u2019\u00e1gua \u00e9 a faixa de vegeta\u00e7\u00e3o ao longo do rio que deve ser preservada para garantir a perenidade, quantidade e qualidade da \u00e1gua do rio, por isso o C\u00f3digo Florestal estabelece um regime restrito de interven\u00e7\u00f5es nessa \u00e1rea.<\/p>\n\n\n\n<p>O problema \u00e9 que, al\u00e9m de prever uma nova modalidade de interven\u00e7\u00e3o em APP, o PL n\u00ba 1282\/2019 n\u00e3o estabelece a obrigatoriedade do licenciamento ambiental para a constru\u00e7\u00e3o do reservat\u00f3rio d\u2019\u00e1gua e, de acordo com o C\u00f3digo Florestal, a faixa de APP de reservat\u00f3rio de \u00e1gua natural ser\u00e1 definida no licenciamento ambiental. Ou seja, <strong>o PL n\u00ba 1282\/2019 permitir\u00e1 a supress\u00e3o de vegeta\u00e7\u00e3o das margens de rios (APP) para a cria\u00e7\u00e3o de reservat\u00f3rios de \u00e1gua sem a garantia de que estes reservat\u00f3rios ter\u00e3o as suas APPs recompostas.<\/strong> Como o projeto n\u00e3o estabelece qualquer limite para a constru\u00e7\u00e3o desses reservat\u00f3rios, os mesmos poder\u00e3o ser criados em quaisquer cursos d\u2019\u00e1gua e os impactos poder\u00e3o ser enormes.<\/p>\n\n\n\n<p>Al\u00e9m disso, o PL n\u00ba 1282\/2019 tamb\u00e9m permitir\u00e1 a interven\u00e7\u00e3o e a supress\u00e3o de vegeta\u00e7\u00e3o nativa em APP para o plantio de culturas tempor\u00e1rias e sazonais na vazante dos rios e lagos e para a pr\u00e1tica de aquicultura.
