{"id":39440,"date":"2021-08-03T13:27:51","date_gmt":"2021-08-03T13:27:51","guid":{"rendered":"https:\/\/www.climatepolicyinitiative.org\/?post_type=cpi_publications&#038;p=39440"},"modified":"2026-05-02T08:19:33","modified_gmt":"2026-05-02T08:19:33","slug":"reposicao-florestal-panorama-da-regulamentacao-nos-estados","status":"publish","type":"cpi_publications","link":"https:\/\/www.climatepolicyinitiative.org\/pt-br\/publication\/reposicao-florestal-panorama-da-regulamentacao-nos-estados\/","title":{"rendered":"Reposi\u00e7\u00e3o Florestal: Panorama da Regulamenta\u00e7\u00e3o nos Estados"},"content":{"rendered":"\n<p>No Brasil, h\u00e1 aproximadamente 100 milh\u00f5es de hectares de vegeta\u00e7\u00e3o nativa em \u00e1reas privadas que n\u00e3o est\u00e3o legalmente protegidos como \u00c1reas de Preserva\u00e7\u00e3o Permanente (APP), Reserva Legal ou Unidades de Conserva\u00e7\u00e3o (Freitas et al. 2018; Sparovek et al. 2015; Soares-Filho et al. 2014). O desmatamento destas \u00e1reas, ainda que permitido por lei, implica em perda de biodiversidade e aumento das emiss\u00f5es de gases de efeito estufa, contribuindo para o agravamento das mudan\u00e7as clim\u00e1ticas. O C\u00f3digo Florestal (Lei n\u00ba 12.651\/2012) imp\u00f5e condi\u00e7\u00f5es para o desmatamento legal destas \u00e1reas, exigindo autoriza\u00e7\u00e3o pr\u00e9via do \u00f3rg\u00e3o ambiental competente e a reposi\u00e7\u00e3o florestal como forma de compensa\u00e7\u00e3o pela perda da vegeta\u00e7\u00e3o.<\/p>\n\n\n\n<p>A reposi\u00e7\u00e3o florestal j\u00e1 est\u00e1 regulamentada tanto em n\u00edvel federal quanto estadual, entretanto, com as altera\u00e7\u00f5es promovidas pelo C\u00f3digo Florestal de 2012, os estados precisam atualizar suas respectivas legisla\u00e7\u00f5es sobre o assunto. A revis\u00e3o da legisla\u00e7\u00e3o estadual tamb\u00e9m ser\u00e1 uma \u00f3tima oportunidade para os estados inovarem, estabelecendo regras que possam tornar a reposi\u00e7\u00e3o florestal um instrumento mais efetivo.<\/p>\n\n\n\n<p><strong>Pesquisadoras do Climate Policy Initiative\/Pontif\u00edcia Universidade Cat\u00f3lica do Rio de Janeiro (CPI\/PUC-Rio) fizeram o levantamento e an\u00e1lise de toda a legisla\u00e7\u00e3o vigente, federal e estadual, referente \u00e0 reposi\u00e7\u00e3o florestal. Este relat\u00f3rio apresenta: (i) a evolu\u00e7\u00e3o legislativa da reposi\u00e7\u00e3o florestal no \u00e2mbito federal; (ii) as normas federais atualmente em vigor; e (iii) um panorama das legisla\u00e7\u00f5es estaduais, identificando como os estados regulamentam os diferentes elementos da reposi\u00e7\u00e3o florestal. Esta caracteriza\u00e7\u00e3o da legisla\u00e7\u00e3o estadual inclui as hip\u00f3teses de imposi\u00e7\u00e3o e isen\u00e7\u00e3o da obriga\u00e7\u00e3o, as modalidades e os crit\u00e9rios t\u00e9cnicos para executar a reposi\u00e7\u00e3o florestal e os mecanismos de monitoramento e transpar\u00eancia.<\/strong><\/p>\n\n\n\n<p class=\"has-background\" style=\"background-color:#f3e3b6\"><span class=\"has-inline-color has-vivid-red-color\"><strong>O QUE \u00c9 REPOSI\u00c7\u00c3O FLORESTAL OBRIGAT\u00d3RIA?<\/strong><br><\/span><br>A reposi\u00e7\u00e3o florestal \u00e9 um mecanismo de compensa\u00e7\u00e3o pela perda de vegeta\u00e7\u00e3o nativa, no qual o respons\u00e1vel pela reposi\u00e7\u00e3o deve promover o plantio de \u00e1rvores de acordo com determinados crit\u00e9rios. A legisla\u00e7\u00e3o tamb\u00e9m prev\u00ea outras modalidades de reposi\u00e7\u00e3o florestal, como o pagamento em dinheiro ou comprova\u00e7\u00e3o de plantio por terceiro. A reposi\u00e7\u00e3o florestal pode ser exigida em decorr\u00eancia de diferentes obriga\u00e7\u00f5es, este relat\u00f3rio trata da reposi\u00e7\u00e3o florestal resultante de autoriza\u00e7\u00e3o de supress\u00e3o de vegeta\u00e7\u00e3o nativa ou de consumo de mat\u00e9ria-prima florestal proveniente desta supress\u00e3o.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Figura 1. Apenas nove estados possuem legisla\u00e7\u00e3o estadual sobre reposi\u00e7\u00e3o florestal totalmente de acordo com as regras federais em vigor. <\/strong>Legisla\u00e7\u00f5es desatualizadas, complexas e deficientes dificultam a aplica\u00e7\u00e3o da reposi\u00e7\u00e3o florestal obrigat\u00f3ria tanto por parte dos \u00f3rg\u00e3os ambientais como pelos devedores da obriga\u00e7\u00e3o.<br><br><strong>Recomenda\u00e7\u00e3o: <\/strong>Os estados com regras inconsistentes e desatualizadas devem atualizar suas respectivas legisla\u00e7\u00f5es, pois a perman\u00eancia de regras contradit\u00f3rias sobre reposi\u00e7\u00e3o florestal dificulta a sua implementa\u00e7\u00e3o.<br><br><strong>2. A reposi\u00e7\u00e3o florestal ainda \u00e9 regulamentada sob a \u00f3tica da sustentabilidade do consumo de mat\u00e9ria-prima.<\/strong> Na maioria dos estados, o instrumento tem o objetivo de garantir o abastecimento de produtos florestais aos diversos segmentos consumidores. Entretanto, a supress\u00e3o de vegeta\u00e7\u00e3o nativa representa bem mais que a simples perda de mat\u00e9ria prima-florestal, pois h\u00e1 tamb\u00e9m perda de biodiversidade e impactos significativos nos servi\u00e7os ambientais.<br><br><strong>Recomenda\u00e7\u00e3o: <\/strong>Os estados devem implementar uma pol\u00edtica de reposi\u00e7\u00e3o florestal que garanta uma efetiva compensa\u00e7\u00e3o ambiental da \u00e1rea de vegeta\u00e7\u00e3o nativa suprimida. Para abastecer o mercado consumidor de mat\u00e9ria-prima florestal, os governos federal e estaduais devem promover pol\u00edticas espec\u00edficas, tais como concess\u00e3o florestal e floresta plantada.<br><br><strong>3. Os crit\u00e9rios t\u00e9cnicos para a reposi\u00e7\u00e3o florestal n\u00e3o garantem uma efetiva compensa\u00e7\u00e3o ambiental pela supress\u00e3o de vegeta\u00e7\u00e3o nativa.<\/strong> Isso acontece porque, na legisla\u00e7\u00e3o federal e na maioria dos estados, os par\u00e2metros permitem a recomposi\u00e7\u00e3o com esp\u00e9cies ex\u00f3ticas e em \u00e1rea menor do que a \u00e1rea de vegeta\u00e7\u00e3o nativa suprimida. Al\u00e9m disso, os crit\u00e9rios de localiza\u00e7\u00e3o n\u00e3o se baseiam em par\u00e2metros t\u00e9cnicos e n\u00e3o promovem a conectividade da paisagem. Somente poucos estados estabelecem metodologia que incorpore crit\u00e9rios inovadores e mapas priorit\u00e1rios para a restaura\u00e7\u00e3o.<br><br><strong>Recomenda\u00e7\u00e3o: <\/strong>O governo federal e os estados devem adotar par\u00e2metros de reposi\u00e7\u00e3o com base nos princ\u00edpios \u201csem perda l\u00edquida de habitat\u201d e de equival\u00eancia ecol\u00f3gica. O estabelecimento de mapas priorit\u00e1rios para a conserva\u00e7\u00e3o e a ado\u00e7\u00e3o de fatores de reposi\u00e7\u00e3o que levam em considera\u00e7\u00e3o a localiza\u00e7\u00e3o e o tipo de vegeta\u00e7\u00e3o suprimida podem tornar a reposi\u00e7\u00e3o florestal muito mais efetiva. Al\u00e9m disso, mecanismos inovadores para cumprimento da reposi\u00e7\u00e3o florestal devem ser criados e incentivados, tais como a cria\u00e7\u00e3o de bancos de \u00e1reas para restaura\u00e7\u00e3o florestal, bem como de prateleiras de projetos de restaura\u00e7\u00e3o previamente selecionados pelo \u00f3rg\u00e3o ambiental competente.<br><br><strong>4. Poucos estados estabeleceram ferramentas de monitoramento e transpar\u00eancia para acompanhamento da reposi\u00e7\u00e3o florestal pela sociedade.<\/strong> O monitoramento cont\u00ednuo das a\u00e7\u00f5es de reposi\u00e7\u00e3o florestal e\u0301 fundamental para observar o progresso da efetiva\u00e7\u00e3o deste instrumento.<br><br><strong>Recomenda\u00e7\u00e3o: <\/strong>Os estados devem implementar e disponibilizar sistemas de informa\u00e7\u00e3o com dados das autoriza\u00e7\u00f5es de supress\u00e3o de vegeta\u00e7\u00e3o nativa (ASV) e dos respectivos cumprimentos de reposi\u00e7\u00e3o florestal.
