Nos \u00faltimos cinco anos j\u00e1 foram editadas ao menos duas medidas provis\u00f3rias, uma lei, tr\u00eas decretos e tr\u00eas instru\u00e7\u00f5es normativas do Incra, al\u00e9m de v\u00e1rios outros atos normativos como resolu\u00e7\u00f5es e portarias, para alterar a Lei n\u00ba 11.952\/2009, que trata da regulariza\u00e7\u00e3o fundi\u00e1ria de posses em terras p\u00fablicas federais, e seus regulamentos. Al\u00e9m disso, h\u00e1 v\u00e1rios projetos de lei (PL) tramitando no Congresso Nacional com o objetivo de alterar o marco legal da regulariza\u00e7\u00e3o fundi\u00e1ria. As modifica\u00e7\u00f5es j\u00e1 implementadas e as que est\u00e3o sendo propostas flexibilizam as regras para a regulariza\u00e7\u00e3o fundi\u00e1ria, beneficiando sobretudo m\u00e9dios e grandes posseiros e anistiando crimes como a grilagem e o desmatamento ilegal. Estas mudan\u00e7as sinalizam que vale \u00e0 pena invadir terras p\u00fablicas porque, em algum momento, a legisla\u00e7\u00e3o poder\u00e1 ser novamente alterada.<\/p>\n\n\n\n<p>No dia 22 de fevereiro de 2021, o Senador Iraj\u00e1 protocolou um novo projeto de lei (PL n\u00ba 510) para modificar mais uma vez a Lei n\u00ba 11.952\/2009. O Senador Iraj\u00e1 foi o relator da Medida Provis\u00f3ria n\u00ba 910, de 10 de dezembro de 2019 e apresentou dois pareceres \u00e0 Comiss\u00e3o Mista da MP. Entretanto, seu parecer n\u00e3o chegou a ser aprovado, pois as atividades da comiss\u00e3o foram suspensas em decorr\u00eancia da pandemia de Covid-19. O Congresso Nacional implementou o Sistema de Delibera\u00e7\u00e3o Remota e um novo procedimento para a tramita\u00e7\u00e3o de medidas provis\u00f3rias. Neste processo, o Senador Iraj\u00e1 acabou sendo substitu\u00eddo por outro relator, o Deputado Z\u00e9 Silva.<\/p>\n\n\n\n<p>A MP n\u00ba 910\/2019 perdeu a validade por n\u00e3o ter sido apreciada no prazo legal. Em seu lugar, foi apresentado o PL n\u00ba 2633, em 14 de maio de 2020, de autoria do Deputado Z\u00e9 Silva. Do texto original da MP n\u00ba 910\/2019 ao texto atual do PL n\u00ba 2633\/2020, muitas proposi\u00e7\u00f5es foram feitas e a reda\u00e7\u00e3o mudou substancialmente. Esse PL ainda est\u00e1 em tramita\u00e7\u00e3o, tendo sido designado um novo relator recentemente.<\/p>\n\n\n\n<p><strong>O PL n\u00ba 510\/2021 \u00e9 praticamente uma c\u00f3pia do segundo parecer do Senador Iraj\u00e1 sobre a MP n\u00ba 910\/2019. O PL altera o marco temporal, flexibiliza os requisitos para a regulariza\u00e7\u00e3o, estende o procedimento simplificado para im\u00f3veis at\u00e9 2.500 hectares e enfraquece as salvaguardas ambientais.<\/strong><\/p>\n\n\n\n<p><strong>Al\u00e9m disso, o PL n\u00ba 510\/2021 inova ao propor altera\u00e7\u00f5es que beneficiam ainda mais m\u00e9dios e grandes posseiros e especuladores de terras p\u00fablicas, pois: (i) permite a regulariza\u00e7\u00e3o fundi\u00e1ria por quem j\u00e1 \u00e9 propriet\u00e1rio de outro im\u00f3vel rural; (ii) permite a regulariza\u00e7\u00e3o fundi\u00e1ria de requerente que j\u00e1 tenha sido beneficiado de programa de reforma agr\u00e1ria ou regulariza\u00e7\u00e3o fundi\u00e1ria; e (iii) permite que o benefici\u00e1rio que transferir ou negociar por qualquer meio o t\u00edtulo obtido nos termos da lei, possa ser novamente beneficiado no futuro de programas de reforma agr\u00e1ria ou regulariza\u00e7\u00e3o fundi\u00e1ria.&nbsp;<\/strong><\/p>\n\n\n\n<p>Para entender o que esta\u0301 em discuss\u00e3o e avaliar as implica\u00e7\u00f5es do PL n\u00ba 510\/2021 nas pol\u00edticas fundi\u00e1ria e ambiental, pesquisadoras do Climate Policy Initiative\/Pontif\u00edcia Universidade Cat\u00f3lica do Rio de Janeiro (CPI\/PUC-Rio) selecionaram os principais par\u00e2metros da Lei n\u00ba 11.952\/2009 alterados pelo PL n\u00ba 510\/2021 (Tabela 1) e compararam a lei em vigor com os dois principais projetos de lei em discuss\u00e3o, o PL n\u00ba 2633\/2020 e o PL n\u00ba 510\/2021. As <strong>salvaguardas ambientais p\u00f3s-titula\u00e7\u00e3o<\/strong> estabelecem os requisitos de conformidade ambiental para a titula\u00e7\u00e3o definitiva da posse.<br>Como as salvaguardas ambientais se baseiam principalmente na verifica\u00e7\u00e3o de autos de infra\u00e7\u00e3o ambiental, algumas propostas de altera\u00e7\u00e3o da lei estabelecem uma defini\u00e7\u00e3o pr\u00f3pria.<\/td><td>A falta de salvaguardas ambientais ou o estabelecimento de salvaguardas fracas permite que a regulariza\u00e7\u00e3o fundi\u00e1ria seja feita em desacordo com a legisla\u00e7\u00e3o ambiental, servindo de pr\u00eamio para quem cometeu crime ambiental.<br>A defini\u00e7\u00e3o de infra\u00e7\u00e3o ambiental \u00e9 dada pelo Decreto n\u00ba 6.514\/2008 que disp\u00f5e sobre as infra\u00e7\u00f5es e san\u00e7\u00f5es administrativas ao meio ambiente. Qualquer defini\u00e7\u00e3o mais restritiva para a aplica\u00e7\u00e3o da lei fundi\u00e1ria \u00e9 um retrocesso ambiental.<\/td><\/tr><tr><td class=\"has-text-align-center\"
