An\u00e1lise do Projeto de Lei N\u00ba 2633\/2020 sob o Enfoque das Salvaguardas Ambientais"},"content":{"rendered":"\n<p>A regulariza\u00e7\u00e3o fundi\u00e1ria de ocupa\u00e7\u00f5es em terras p\u00fablicas \u00e9 um tema complexo. O reconhecimento das posses antigas \u00e9 uma medida justa e necess\u00e1ria, pois ocupantes de terras p\u00fablicas, sobretudo na regi\u00e3o norte, foram incentivados pelo governo a ocupar e produzir nestas \u00e1reas. Entretanto, a regulariza\u00e7\u00e3o de ocupa\u00e7\u00f5es recentes, de \u00e1reas maiores que a posse familiar, e as mudan\u00e7as constantes no marco legal s\u00e3o um incentivo \u00e0 grilagem e ao desmatamento ilegal. Devido a esses efeitos adversos, essas quest\u00f5es precisam ser tratadas com cautela.<\/p>\n\n\n\n<p>O governo federal criou em 2009 o Programa Terra Legal, por meio da Lei n\u00ba 11.952\/2009, e estabeleceu um procedimento mais simples e c\u00e9lere para regularizar as ocupa\u00e7\u00f5es de terras p\u00fablicas na Amaz\u00f4nia Legal. O objetivo era reduzir os conflitos e permitir seguran\u00e7a jur\u00eddica, inser\u00e7\u00e3o produtiva e acesso \u00e0s pol\u00edticas p\u00fablicas para os ocupantes destas terras. Em 2017, o governo federal alterou o marco legal com o objetivo de ampliar o escopo temporal e espacial da lei fundi\u00e1ria e a \u00e1rea pass\u00edvel de regulariza\u00e7\u00e3o.<\/p>\n\n\n\n<p>Os impactos das altera\u00e7\u00f5es promovidas pelo governo em 2017 ainda n\u00e3o tinham sido totalmente avaliados, quando o atual governo editou a Medida Provis\u00f3ria MP n\u00ba 910, em 10 de dezembro de 2019 (MP n\u00ba 910\/2019), para ampliar ainda mais o escopo temporal e flexibilizar ainda mais os par\u00e2metros da Lei n\u00ba 11.952\/2009. A MP n\u00ba 910\/2019 foi bastante criticada e sua tramita\u00e7\u00e3o enfrentou obst\u00e1culos, sobretudo porque sobreveio o estado de calamidade p\u00fablica decorrente da pandemia da Covid-19. A MP n\u00ba 910\/2019 acabou n\u00e3o sendo apreciada pelo Congresso Nacional no prazo legal e perdeu a validade. Em seu lugar, foi proposto o PL n\u00ba 2633, em 14 de maio de 2020 (PL n\u00ba 2633\/2020).<\/p>\n\n\n\n<p>Do texto original da MP n\u00ba 910\/2019, proposto pelo Executivo, passando por todos os relat\u00f3rios legislativos apresentados pelos relatores da MP, ao texto atual do PL n\u00ba 2633\/2020, muitas proposi\u00e7\u00f5es foram feitas e a reda\u00e7\u00e3o mudou substancialmente em rela\u00e7\u00e3o a diversos par\u00e2metros, em especial relacionados ao marco temporal, aos requisitos para a regulariza\u00e7\u00e3o fundi\u00e1ria, \u00e0<br>aplica\u00e7\u00e3o de procedimento simplificado de regulariza\u00e7\u00e3o, \u00e0 defini\u00e7\u00e3o de infra\u00e7\u00e3o ambiental e \u00e0s salvaguardas ambientais.<sup>1<\/sup> Dentre esses par\u00e2metros, as salvaguardas ambientais ocuparam um papel relevante neste processo e foram usadas como moeda de troca para obter apoio, pois foram apresentadas como avan\u00e7os consider\u00e1veis em rela\u00e7\u00e3o ao marco legal vigente.<\/p>\n\n\n\n<p>Para entender o que est\u00e1 em discuss\u00e3o e avaliar a efic\u00e1cia do atual PL n\u00ba 2633\/2020, pesquisadoras do Climate Policy Initiative\/Pontif\u00edcia Universidade Cat\u00f3lica do Rio de Janeiro (CPI\/PUC-Rio) fizeram uma an\u00e1lise detalhada da legisla\u00e7\u00e3o fundi\u00e1ria em vigor e de todas as propostas que foram discutidas ao longo do processo de tramita\u00e7\u00e3o da MP n\u00ba 910\/2019 e do PL n\u00ba 2633\/2020.<\/p>\n\n\n\n<p>Nesta nota t\u00e9cnica, as pesquisadoras do CPI\/PUC-Rio: (i) descrevem o hist\u00f3rico da tramita\u00e7\u00e3o da MP n\u00ba 910\/2019 e do PL n\u00ba 2633\/2020; (ii) examinam como evolu\u00edram os principais par\u00e2metros em discuss\u00e3o nestas propostas; e (iii) analisam as salvaguardas ambientais da legisla\u00e7\u00e3o fundi\u00e1ria em vigor e as propostas no PL n\u00ba 2633\/2020. As pesquisadoras conclu\u00edram que as salvaguardas ambientais propostas no PL n\u00ba 2633\/2020 s\u00e3o insuficientes e ineficazes e que existe uma necessidade e oportunidade de promover a integra\u00e7\u00e3o das pol\u00edticas fundi\u00e1ria e ambiental.<\/p>\n\n\n\n<p><strong>PRINCIPAIS DESTAQUES<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>O PL n\u00ba 2633\/2020 apresenta avan\u00e7os em rela\u00e7\u00e3o \u00e0 vers\u00e3o original da MP n\u00ba 910\/2019, mas, ainda assim, as mudan\u00e7as propostas n\u00e3o parecem justificar a altera\u00e7\u00e3o da Lei n\u00ba 11.952\/2009.<br><\/li><li>As salvaguardas ambientais propostas no PL n\u00ba 2633\/2020 s\u00e3o extremamente limitadas e ineficazes. Se o controle ambiental no processo de regulariza\u00e7\u00e3o fundi\u00e1ria se apoiar apenas na verifica\u00e7\u00e3o de autos de infra\u00e7\u00e3o e em embargos, ao final ser\u00e3o tituladas \u00e1reas que foram desmatadas ilegalmente, sem que o propriet\u00e1rio tenha obriga\u00e7\u00e3o de regularizar os passivos ambientais. Nesse sentido, a regulariza\u00e7\u00e3o fundi\u00e1ria servir\u00e1 como pr\u00eamio para quem cometeu crimes ambientais.<br><\/li><li>O Minist\u00e9rio da Agricultura, Pecu\u00e1ria e Abastecimento (MAPA) \u00e9 respons\u00e1vel tanto por a\u00e7\u00f5es de pol\u00edtica fundi\u00e1ria como por a\u00e7\u00f5es de regulariza\u00e7\u00e3o ambiental \u00e0 luz do C\u00f3digo Florestal, tendo a oportunidade de promover a integra\u00e7\u00e3o destas pol\u00edticas de forma estrat\u00e9gica e sin\u00e9rgica, independentemente de qualquer altera\u00e7\u00e3o no marco regulat\u00f3rio.<br><\/li><li>Novas propostas de altera\u00e7\u00e3o do marco legal da regulariza\u00e7\u00e3o fundi\u00e1ria de ocupa\u00e7\u00f5es em terras p\u00fablicas federais precisam ser precedidas de um amplo debate na sociedade sobre o destino deste patrim\u00f4nio, que \u00e9 de todos os brasileiros, e tais medidas n\u00e3o podem legitimar a grilagem e o desmatamento ilegal.<\/li><\/ul>\n\n\n\n<hr class=\"wp-block-separator is-style-wide\" \/>\n\n\n\n<p>[1] Neste documento, consideramos salvaguardas ambientais os dispositivos na legisla\u00e7\u00e3o fundi\u00e1ria que promovem a prote\u00e7\u00e3o do meio ambiente e\/ou vinculam a regulariza\u00e7\u00e3o fundi\u00e1ria ao cumprimento de regras de conformidade ambiental, sobretudo as regras do C\u00f3digo Florestal para a regulariza\u00e7\u00e3o ambiental das \u00c1reas de Preserva\u00e7\u00e3o Permanente (APP) e Reserva Legal.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Para entender o que est\u00e1 em discuss\u00e3o e avaliar a efic\u00e1cia do atual PL n\u00ba 2633\/2020, pesquisadoras do CPI\/PUC-Rio fizeram uma an\u00e1lise detalhada da legisla\u00e7\u00e3o fundi\u00e1ria em vigor e de todas as propostas que foram discutidas ao longo do processo de tramita\u00e7\u00e3o da MP n\u00ba 910\/2019 e do PL n\u00ba 2633\/2020.<\/p>\n","protected":false},"author":76,"featured_media":35209,"template":"","format":"standard","meta":{"_acf_changed":false},"programs":[1241],"regions":[1377],"topics":[1458,1267,1243],"collaborations":[],"class_list":["post-35096","cpi_publications","type-cpi_publications","status-publish","format-standard","has-post-thumbnail","hentry","programs-brazil-policy-center","regions-brasil","topics-analise-legal","topics-direito-e-governanca-do-clima","topics-uso-da-terra"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Avan\u00e7os ou Retrocessos na Regulariza\u00e7\u00e3o Fundi\u00e1ria?
