O novo C\u00f3digo Florestal brasileiro (Lei Federal n\u00ba 12.651\/2012), que disp\u00f5e sobre o uso e prote\u00e7\u00e3o da vegeta\u00e7\u00e3o nativa em terras p\u00fablicas e privadas, \u00e9 uma das leis ambientais mais importantes do pa\u00eds, com o potencial de impulsionar o uso eficiente da terra e se tornar um instrumento efetivo na mitiga\u00e7\u00e3o das mudan\u00e7as clim\u00e1ticas, permitindo que o pa\u00eds cumpra as metas estabelecidas internacionalmente.<\/p>\n<p>Outros importantes pa\u00edses produtores agr\u00edcolas tamb\u00e9m est\u00e3o se empenhando para desenvolver suas economias sem deixar de proteger seus recursos naturais.<\/p>\n<p>Este estudo identifica, analisa e compara legisla\u00e7\u00f5es de prote\u00e7\u00e3o florestal e de uso da terra de sete pa\u00edses, dentre os dez maiores agroexportadores, quais sejam, Argentina, Brasil, Canad\u00e1, China, Fran\u00e7a, Alemanha e Estados Unidos, com o objetivo de entender:<\/p>\n<ul>\n<li>O que significa a implementa\u00e7\u00e3o efetiva do C\u00f3digo Florestal brasileiro se comparado \u00e0s exig\u00eancias legais de outros pa\u00edses?<\/li>\n<li>Quais s\u00e3o os outros instrumentos existentes para a prote\u00e7\u00e3o das florestas, al\u00e9m de regras de comando e controle?<\/li>\n<\/ul>\n<p>O principal objetivo deste estudo, desenvolvido por pesquisadoras do Climate Policy Initiative\/ N\u00facleo de Avalia\u00e7\u00e3o de Pol\u00edticas Clim\u00e1ticas da PUC-Rio (CPI\/NAPC), atrav\u00e9s do projeto INPUT, \u00e9 responder sobretudo a primeira quest\u00e3o, analisando se os outros pa\u00edses possuem limita\u00e7\u00f5es ao uso das propriedades rurais, assim como o faz o C\u00f3digo Florestal brasileiro. Esta an\u00e1lise \u00e9 feita a partir da compara\u00e7\u00e3o entre o arcabou\u00e7o jur\u00eddico de cada pa\u00eds, identificando:<\/p>\n<p>(i) \u00c1reas de Preserva\u00e7\u00e3o Permanente (APP) rip\u00e1rias e outros tipos de APP, e;<\/p>\n<p>(ii) Pol\u00edticas de conserva\u00e7\u00e3o da biodiversidade.<\/p>\n<p>Em uma segunda etapa, ser\u00e3o feitos de forma mais aprofundada o mapeamento, a an\u00e1lise e a compara\u00e7\u00e3o dos demais instrumentos existentes para a prote\u00e7\u00e3o das florestas nos pa\u00edses selecionados.<\/p>\n<p>Os resultados deste estudo podem ser usados para beneficiar os pa\u00edses que possuem relevantes compromissos clim\u00e1ticos e ambientais, fornecendo transpar\u00eancia sobre a contribui\u00e7\u00e3o de cada pa\u00eds no desenvolvimento de uma economia de baixo carbono. Adicionalmente, pol\u00edticas e instrumentos utilizados por outros pa\u00edses ensinam e abrem caminho para que tamb\u00e9m possam ser utilizados para aprimorar a conserva\u00e7\u00e3o de florestas e implementa\u00e7\u00e3o efetiva do C\u00f3digo Florestal no Brasil.<\/p>\n<p>Este resumo apresenta um breve exame do cen\u00e1rio florestal internacional, a metodologia aplicada e as principais conclus\u00f5es da an\u00e1lise. Duas tabelas ilustram as principais pol\u00edticas de prote\u00e7\u00e3o de APP rip\u00e1rias e conserva\u00e7\u00e3o da biodiversidade em \u00e1reas privadas nos pa\u00edses examinados.
