A pesquisa tamb\u00e9m discutiu a ado\u00e7\u00e3o desse mecanismo no \u00e2mbito do C\u00f3digo Florestal.<\/p>\n<p>No Brasil, a Constitui\u00e7\u00e3o Federal prev\u00ea que as condutas e as atividades prejudiciais ao meio ambiente sujeitar\u00e3o os infratores a san\u00e7\u00f5es penais e administrativas, independentemente da obriga\u00e7\u00e3o de reparar os danos causados. Al\u00e9m disso, imp\u00f5e ao poder p\u00fablico a obriga\u00e7\u00e3o de defender e preservar o meio ambiente, seja por meio de a\u00e7\u00f5es preventivas como tamb\u00e9m a\u00e7\u00f5es repressivas, como a imposi\u00e7\u00e3o de multa em caso de infra\u00e7\u00e3o ambiental. <\/p>\n<p>Segundo Joana Chiavari, analista do NAPC\/ CPI e uma das autoras do estudo, a convers\u00e3o de multa apresenta diversas vantagens, tanto para o autuado como para a Administra\u00e7\u00e3o P\u00fablica. \u201cAl\u00e9m de possibilitar o di\u00e1logo em situa\u00e7\u00f5es conflituosas, esse instrumento permite um acordo mais \u00e1gil entre o \u00f3rg\u00e3o ambiental e o infrator para a repara\u00e7\u00e3o integral dos danos ambientais, pois n\u00e3o \u00e9 necess\u00e1rio recorrer ao Poder Judici\u00e1rio\u201d. Outra vantagem \u00e9 que a convers\u00e3o de multa procura engajar o autuado na causa ambiental.<\/p>\n<p><strong>Obst\u00e1culos e recomenda\u00e7\u00f5es<\/strong><br \/>\nDe acordo com o estudo, os principais entraves para que a convers\u00e3o de multas seja aplicada s\u00e3o as mudan\u00e7as constantes nas normas que regem o tema, a aus\u00eancia de jurisprud\u00eancia com base na legisla\u00e7\u00e3o em vigor e a falta de quadro t\u00e9cnico capacitado. <\/p>\n<p>Para Chiavari, \u00e9 importante regulamentar a convers\u00e3o de multa ambiental e definir as regras que melhor atendem aos objetivos da nova regulamenta\u00e7\u00e3o \u2013 que pode ser tanto uma instru\u00e7\u00e3o normativa do Ibama ou um decreto federal. A analista defende que a regulamenta\u00e7\u00e3o por decreto oferece liberdade para inovar, estabelecendo, por exemplo, outros servi\u00e7os ambientais para fins de quita\u00e7\u00e3o da multa, como a aquisi\u00e7\u00e3o de Cotas de Reserva Ambiental (CRA) ou a ades\u00e3o de editais de restaura\u00e7\u00e3o florestal.<\/p>\n<p>Outra recomenda\u00e7\u00e3o feita pelo estudo \u00e9 a promo\u00e7\u00e3o de cursos de capacita\u00e7\u00e3o para os t\u00e9cnicos do Ibama, para inform\u00e1-los sobre o instrumento da convers\u00e3o de multa ambiental e ao mesmo tempo capacit\u00e1-los para a an\u00e1lise dos projetos de convers\u00e3o de multa. <\/p>\n<p><strong>Falha no artigo 42 do C\u00f3digo Florestal<\/strong><br \/>\nO estudo tamb\u00e9m analisou o programa de convers\u00e3o de multa prevista no artigo 42 do novo C\u00f3digo Florestal. As analistas do NAPC\/ CPI constataram que h\u00e1 uma grande inseguran\u00e7a jur\u00eddica por conta da impossibilidade de se atender dois requisitos impostos por esse artigo: que a supress\u00e3o de vegeta\u00e7\u00e3o tenha ocorrido antes de 22\/07\/2008 e que o auto de infra\u00e7\u00e3o seja lavrado com base no Decreto 6.514\/2008.
